Terms of Service

These terms are a binding agreement between MB "AI Konsultacijos", a private company registered in Lithuania, company code 306436438, registered office at Ulonų g. 1-37, LT-08240 Vilnius, Lithuania ("pod.builders", "we"), and you, the person or company using the pod.builders service. Each section starts with a plain-words summary. The summaries are here to help and are not legally binding - the full text is what counts.

1. What pod.builders is (and is not)

In plain words: Bob is software that builds and runs your print-on-demand store - you approve every product before it is published. The store, the products, and the business are yours. Printing is done by print providers via Printify, and selling happens on Etsy - we control neither.

pod.builders provides an AI agent ("Bob") that researches niches, generates designs, creates product listings, prices products, and - once you approve them - publishes them to your store on third-party platforms (currently Etsy, with fulfillment via Printify and its print providers). We provide software. We are not a party to your sales, we do not print, manufacture, ship, or sell products, and we are not a marketplace.

You are the merchant of record for your store. Your relationship with Etsy is governed by Etsy's terms, your relationship with Printify by Printify's terms, and the quality and delivery of physical products is the responsibility of the print providers who make them. We do not guarantee that products will match mockups, that listings will rank, or that anything will sell.

2. Eligibility and accounts

In plain words: You must be 18+, give us a real email you check, and keep your account to yourself.

  • You must be at least 18 years old and able to enter a binding contract to use the service.
  • Sign-in is by email link. You are responsible for the security of your email inbox and for everything done through your account.
  • You must provide accurate information, including a working email address - it is how your sign-in links, store alerts, and billing notices reach you.

3. Your content and AI-generated designs

In plain words: Designs Bob makes for you are yours. You check and approve them before they go live, and you are responsible for what you publish - including if a design infringes someone's rights. Bob's trademark screening helps, but it is not legal clearance.

Ownership.As between you and us, you own the designs, listings, and other content that Bob generates for you in your store, as well as anything you upload or write yourself (together, "Your Content"), to the extent permitted by applicable law. We claim no ownership of your store or your products.

License to us. You grant us a non-exclusive, worldwide, royalty-free, perpetual, sublicensable license to use, store, reproduce, modify, and display Your Content for the purposes of (a) operating, providing, and improving the service, and (b) promoting the service, for example showing real stores and designs in marketing material. This license does not allow us to sell Your Content or your products as our own.

AI-generated content.Bob's designs and texts are produced by artificial intelligence. You acknowledge that:

  • AI outputs are not guaranteed to be unique - similar or identical outputs may be generated for other users or by other tools;
  • AI outputs are not guaranteed to be free of third-party rights. Bob runs automated trademark screening as a courtesy, but no automated system catches everything. It is not legal advice or clearance, and you remain solely responsible for confirming you have the right to sell what you publish;
  • you review and approve products before they are published, and by publishing you represent and warrant that Your Content - whether uploaded by you or generated by Bob at your direction - does not infringe any third-party rights, including copyright, trademark, and rights of publicity, and complies with Etsy's and Printify's policies.

4. Acceptable use

In plain words: Do not use Bob to make or sell anything illegal, hateful, infringing, or harmful - and do not abuse the service itself.

You may not use the service to create, publish, or sell content that:

  • exploits or sexualizes minors in any way;
  • harasses, bullies, defames, or threatens a person;
  • promotes hatred or violence against people based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or similar characteristics, or promotes terrorism;
  • is illegal where you operate or where you sell;
  • infringes intellectual property or other rights of others;
  • contains other people's personal or confidential information without consent;
  • promotes self-harm or harmful misinformation.

You also may not:

  • circumvent usage limits, captchas, or other protective measures, or use the service with automated agents except through features we provide;
  • reverse engineer, copy, resell, or build a competing dataset or product from the service;
  • share your account or use someone else's.

We may remove content or suspend accounts that we reasonably believe violate these rules, with or without notice.

5. Subscriptions and billing

In plain words: Building is free. Publishing and running a store needs a subscription: $89/month or $250/year, charged by Stripe. Cancel anytime from your Account page - access runs to the end of what you paid for.

  • Trying Bob - researching niches, generating designs, building a draft store - is free. An active subscription is required to publish products and use the full dashboard.
  • Pricing: USD 89 per month, or USD 250 per year. Prices are shown before tax; VAT or sales tax is added at checkout where applicable. Payments are processed by Stripe - we never see or store your card number.
  • Subscriptions renew automatically until cancelled. You can cancel any time, self-serve, via Account → Manage billing. Cancellation takes effect at the end of the paid period and you keep access until then.
  • EU/EEA consumers: by subscribing you expressly consent to immediate access to the service and acknowledge that you thereby lose your 14-day right of withdrawal under EU consumer law. You confirm this at checkout.
  • Your store, designs, and Etsy listings remain yours after cancellation. Etsy and Printify fees are separate and yours to manage.

6. Refunds

In plain words: No advertised money-back guarantee, but we are humans: email us and we will sort out fair cases. If you open a card dispute, we cannot refund until it is closed.

Refunds are at our discretion. If something went wrong, email bob@pod.builders and we will look at it case by case - we want you to leave a fair interaction even if you leave the product.

If you open a chargeback or payment dispute with your card issuer, we are unable to issue a refund while the dispute is pending, and any refund already agreed is paused until the dispute is resolved or withdrawn. Please contact us first - it is faster for everyone.

7. Third-party services

In plain words: Etsy, Printify, Stripe, and our AI providers have their own terms, and we are not responsible for their services.

The service depends on third parties: Etsy (your storefront), Printify and its print providers (production and fulfillment), Stripe (payments), and AI model providers (design and text generation). Their terms and policies apply to your use of their services, and we are not responsible for their acts, omissions, outages, or decisions - including Etsy suspending a shop or a print provider misprinting an order. Where we can, we will help you resolve issues with them.

8. Intellectual property complaints

In plain words: If you think a store on pod.builders infringes your rights, email us with the details and we will act on valid notices.

We respect intellectual property rights and expect users to do the same. If you believe content created or hosted through pod.builders infringes your copyright, trademark, or other rights, email bob@pod.builders with: (a) your name and contact details and the right you hold, (b) a link to or description of the infringing content, (c) a link to or evidence of the original work, and (d) a statement, under penalty of perjury, that you believe in good faith the use is unauthorized and that your notice is accurate.

On receiving a valid notice we will review it promptly, may remove or disable the content, and will make a reasonable attempt to notify the user who posted it so they can respond. Accounts that repeatedly infringe may be suspended or terminated.

9. Disclaimers and limitation of liability

In plain words: The service is provided as-is. We are not liable for lost profits or your business outcomes, and our total liability is capped at what you paid us in the last 12 months.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI OUTPUTS WILL BE ACCURATE, UNIQUE, OR FIT FOR YOUR PURPOSE, OR THAT YOUR STORE WILL ACHIEVE ANY LEVEL OF SALES OR REVENUE.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, OR DATA. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING MANDATORY EU CONSUMER PROTECTIONS.

You agree to indemnify us against third-party claims arising from your breach of these terms, your violation of law, or Your Content - including products you chose to publish.

10. Termination

In plain words: You can leave anytime. We can suspend accounts that break these terms.

You may stop using the service and cancel your subscription at any time. We may suspend or terminate accounts that violate these terms, abuse the service, or create legal risk, and we may discontinue the service with reasonable notice. Sections that by their nature should survive termination (including ownership, liability limits, and governing law) survive.

11. Changes, governing law, and disputes

In plain words: Lithuanian law governs. Talk to us first; unresolved disputes go to Lithuanian courts. EU consumers keep their local protections.

We may update these terms; if a change is material we will notify you (for example by email or an in-product notice) before it takes effect. Continued use after the effective date means you accept the updated terms.

These terms are governed by the laws of the Republic of Lithuania. If a dispute arises, contact us first at bob@pod.builders and we will try to resolve it informally. Unresolved disputes are subject to the courts of the Republic of Lithuania. If you are a consumer in the EU/EEA, you keep any mandatory protections and venue rights of your country of residence, and you may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
